Any order placed on the website constitutes full and unconditional acceptance of these T&Cs by the customer (hereinafter referred to as the “Buyer”).
2. Products
Products are manufactured or customized to order and delivered within the estimated timelines indicated on each product page.
Images, photographs and visual representations on the website are for illustrative purposes only and have no contractual value. Minor variations (including but not limited to color shades, size, or finishes) may occur. The Seller shall not be held liable for such variations.
3. Availability
Products are offered for sale subject to stock availability or production capacity.
If an item becomes unavailable after an order has been confirmed, the Buyer will be notified promptly and reimbursed within a maximum of 14 days.
4. Prices
All prices are indicated in euros, inclusive of applicable taxes (or with the mention “VAT not applicable – art. 293 B of the French Tax Code” where applicable).
Shipping costs are specified during the checkout process before final confirmation of the order.
Prices displayed in currencies other than euros are for information only. Payment and invoicing are always processed in euros.
5. Orders
By confirming an order, the Buyer enters into a firm and binding purchase contract.
The Seller reserves the right to refuse or cancel any order in the event of non-payment, fraud suspicion, abusive conduct, or any previous dispute with the Buyer.
6. Payment
Payment is due in full at the time of ordering, via the secure payment methods offered on the website (e.g., credit/debit card, PayPal, etc.).
The Seller has no access to the Buyer’s banking details, which are processed securely by third-party payment providers.
7. Delivery
Products are manufactured or prepared to order and shipped directly from our logistics partners.
Estimated delivery times are provided on each product page and may vary depending on the shipping destination.
The Seller shall not be liable for delivery delays caused by carriers, customs authorities, or events beyond its reasonable control (force majeure).
Any customs duties, import taxes, or local charges remain the sole responsibility of the Buyer.
8. Withdrawal, Returns & Refunds
In accordance with applicable consumer protection laws (EU Directive 2011/83/EU and related national implementations), the Buyer may have a statutory 14-day withdrawal right from the date of receipt of goods, except in cases expressly excluded by law, including but not limited to:
- Products made to the Buyer’s specifications or clearly personalized (e.g., items with a name, image, or custom text provided by the Buyer).
- Items unsealed and unsuitable for return due to hygiene or health protection reasons.
Where the withdrawal right applies, the Buyer must notify the Seller in writing (email or letter) within the statutory timeframe. Return shipping costs are borne entirely by the Buyer. Returned products must be unused, unwashed, and in their original condition and packaging.
Refunds will be processed within 14 days of receipt and inspection of the returned goods.
Outside this legal framework, no returns or refunds will be accepted.
9. Liability
The Seller undertakes to deliver products that comply with the order and are of satisfactory quality. However, the Seller shall not be liable for:
- Delivery delays, losses or disruptions caused by carriers or external circumstances beyond its control (force majeure).
- Damages resulting from misuse, improper maintenance, negligence, or normal wear and tear by the Buyer.
- Minor differences in appearance, color, or finish that do not affect the essential function of the product.
In any case, the Seller’s liability shall be strictly limited to the total amount of the order.
No consequential, indirect, or punitive damages shall be claimed against the Seller.
10. Legal Warranties
The Seller remains bound by applicable statutory warranties, including:
- Conformity warranty (EU: Directive 2019/771 and national consumer codes).
- Warranty against hidden defects (French Civil Code articles 1641–1649).
The Buyer must contact customer service immediately in case of a defect or issue.
11. Personal Data
Personal data collected (name, postal address, email, phone number) are necessary for order processing.
They are never sold or shared with unauthorized third parties.
The Buyer retains rights of access, rectification, and deletion of their data by contacting hello@frutiga.com.

12. Governing Law & Dispute Resolution
These T&Cs are governed by French law.
In case of a dispute, the parties shall first seek an amicable resolution. Failing this, exclusive jurisdiction is attributed to the competent French courts.
For international buyers, mandatory local consumer rights may also apply, without prejudice to the above jurisdiction clause.
